Guidance for Members from the Department of Administration

Some members of the task force have sought guidance from the Department of Administration (DOA) about whether their work on this task force will impact their employers’ ability to participate in procurement opportunities from the State of Wisconsin. Based on the Governor’s directive to the task force, DOA does not anticipate the work of the task force would create a situation that would impact any participant’s employer’s ability to participate in state procurements, or result in the bidder’s employer needing to disclose a conflict of interest under State Procurement Manual PRO-206. DOA notes that participation on this task force does not constitute “employment” with DWD or any other state contracting agency as it is described in PRO-206.

Furthermore, unless the Task Force decides to move its work beyond the general recommendation of an AI solution into the development of specific procurement specifications to be used in a future solicitation, it is unlikely that the individual participating on the Task Force would get advance access to the type of information that could (if shared) put their employer at an advantage. If the task force does move into such requirements-writing work, specific task force members from companies that may want to participate in the eventual procurement for such an AI solution should expect to either opt out of such requirements-writing activity or take steps (and attest to DOA of such steps) to wall themselves off from the other members/divisions of their company that would respond to any such procurement resulting from the recommendations of the task force.
