Purpose

Announce exhibit requirements for hearings.

Background

On July 30, 2021, exhibit requirements for all in-person hearings were announced by the Division of Hearings and Appeals (DHA) at the Department of Administration. These requirements were discontinued when worker's compensation adjudicatory functions were returned to the Department of Workforce Development's Worker's Compensation Division (WCD) effective Jan. 1, 2026, under the authority of 2025 Wisconsin Act 33. The policy requirements for all in-person hearings that were implemented in 2021 are now in effect again. As a reminder, these policy requirements include:

For all hearings the parties are required to bring a complete set of the exhibits they plan to offer into evidence at the hearing. Please pre-mark the exhibits, Applicant's A-Z and Respondent's 1-100, and include an exhibit list. The parties should also bring a complete copy of their exhibits for the opposing counsel(s) or e-mail a complete copy to the opposing counsel(s) prior to the hearing.

Please note that this does not alter any statutory or rule requirements for filing documents with the Worker's Compensation Division through the Litigated Case Portal, Litigated Fax or US Mail.
