Subject - Internship/Temporary Work Agreement Updates
There have been cases where the I/TW authorized hours were exceeded or overtime occurred.
Due to this the DVR's Internship/Temporary Work Agreement (DVR-17206-E) form has been updated to add and clarify that:
- A consumer is not allowed to work over the weekly hours authorized on the signed agreement.
- Any work performed beyond the authorized hours potentially creates an employment relationship between the site employer and the consumer. If the consumer works beyond the authorized hours, the site employer agrees it has created an employment relationship and is therefore responsible for all hours worked beyond those authorized, as well as compliance with all employment laws.
- The I/TW service provider shall monitor the consumer's work hours to ensure that neither the consumer nor the site employer exceeds the authorized hours.
The PDF version highlights the specific changes made.
Internship/Temporary Work Guidance - Updated to clarify that overtime is not allowed for I/TWs and to align with changes made to the I/TW Agreement.
Internship/Temporary Work Frequently Asked Questions (FAQs) - Updated to reflect that OT is not allowed and align with the changes made to the I/TW Agreement.
This change is effective immediately.
Previous versions of the I/TW Agreement form, I/TW guidance, and I/TW FAQs.
Why is this change being made?
There are cases where the I/TW authorized hours were exceeded or overtime occurred.
All DVR staff must review the updated documents and Directors/Supervisors should ensure these changes are discussed in their WDA/Team meetings as well as with the Service Providers.
Please consult with your WDA Director or VR Supervisor if you have questions related to the policy updates.
