- Call to Order/Introductions: Ms. Huntley-Cooper convened the
Worker’s Compensation Advisory Council (WCAC) meeting via teleconference at
approximately 1:30 p.m. in accordance with Wisconsin’s open meetings law.
WCAC members, staff and members of the audience introduced themselves.
- Minutes: The minutes of the November 12, 2009 meeting were
unanimously approved without correction.
- Draft Legislative Proposal Final Review: Mr. O’Malley
explained that the changes in the final draft included the changes in
language requested by Labor. The bill drafter previously made two changes
to the bill in §§102.18 (1)(bp) and 102.44(1) introductory sentence. Both
changes were removed from the final bill draft. Management advised that
written notice of the basis for bad faith claims was sufficient rather than
requiring a formal prehearing conference in each case where bad faith was
alleged. The draft language in the proposed §102.17(1)(a)(3) requires that
notice with reasonable specificity of the bad faith claim be provided before
a formal hearing is scheduled. The drafter separated §102.17(1)(a) into 4
subdivisions and changed the numbering in §102.44 to modernize the
numbering. These technical changes do not result in any substantive law
changes.
Mr. Newby moved to accept the final bill draft. Mr. Buchen seconded the
motion. The final bill draft was approved by unanimous vote.
- Adjournment: Discussion on all agenda items concluded and the
meeting was adjourned at approximately 1:50 p.m.
