Call to order.  The meeting was called to order by the acting Chair, Ms. Joswiak at 9:16 A.M. in conformance with Wisconsin’s open meeting law.

Open session

Reappointment. Ms. Neuman was presented with a letter from DWD Secretary Gassman, reappointing Ms. Neuman for another 3 year term on the Council.

Mr. Wittry arrived at 9:22 AM and assumed the Chair.

Review and approval of the minutes of the previous meeting. Minutes of the August 5, 2005 meeting were reviewed, and approved as written.

Closed session Arkansas Best Corporation presentation. In accordance with s. 19.85(1)(f) the council convened in closed session to review financial, loss experience, safety and other information of Arkansas Best Corporation. Some of the company’s specific financial or other business information may be confidential and not subject to public disclosure.

Closed session Dairyland Power Cooperative presentation. In accordance with s. 19.85(1)(f) the council convened in closed session to review financial, loss experience, safety and other information of Dairyland Power Cooperative. Some of the company’s specific financial or other business information may be confidential and not subject to public disclosure.

Closed session review reports of self-insured employers. In accordance with s. 19.85(1)(f) the council convened in closed session to review financial, loss experience, safety and other information of employers presently or previously exempt from the duty to insure. Some of the companies’ specific financial or other business information may be confidential and not subject to public disclosure.

Open session

The Council returned to open session, and made the following recommendations:

Applications:

The self-insurance application of Arkansas Best Corporation is approved, subject to a $1 million surety bond and specific excess insurance with a retention of $1 million and statutory limits.

The self-insurance application of Dairyland Power Cooperative is approved, subject to a $500,000 surety bond and specific excess insurance with a retention of $500,000 and $35 million upper limits.

Changes to specific excess insurance and/or security requirements.

Delphi Corp. – Required bond increase to $5 million.

Other business

The Council reviewed AB 686, a bill that proposes to allow group self-insurance for loggers. As written, the proposal has significant negative consequences for the self-insurance program, especially the fact that the individual self-insurers would be liable if a group were to fail. The Division will keep the Council informed as information becomes available.

Next meeting. Mr. Moreth will poll the members for acceptable dates in Spring 2006, as applications or conditions warrant.
