U.S. immigration law allows an alien to become a permanent resident of the United States based on a job offer, only if it can be shown that qualified U.S. workers (citizens, nationals, permanent resident aliens, temporary residents, refugees and those granted asylum) are not available and willing to perform that job. Foreign Labor Certification (FLC) is the process employers must use to document that their hiring needs cannot be met by U.S. workers.
Only USCIS has authority over immigration matters and an alien’s authority to work in the U.S. If you have immigration questions, please call 1-800-375-5283 or visit the United States Citizenship and Immigration Services (USCIS) website.
