Foreign Labor Certification 

Update

Please be aware that the effective date of the new labor certification rule identified as PERM is March 28, 2005.  All applications submitted on or after March 28, 2005 for permanent positions in Wisconsin must use the new procedures published in the December 27, 2004 Federal Register and be sent to:

PERM Applications for labor certification may also be filed electronically.

The Wisconsin office is only responsible for processing temporary H2-A and H2-B applications. Applications for H2-A and H2-B labor certification for jobs in Wisconsin must be submitted to:

Overview

U.S. immigration law allows an alien to become a permanent resident of the United States based on a job offer, only if it can be shown that qualified U.S. workers (citizens, nationals, permanent resident aliens, temporary residents, refugees and those granted asylum) are not available and willing to perform that job. Foreign Labor Certification (FLC) is the process employers must use to document that their hiring needs cannot be met by U.S. workers.
